O R D E R
As provided under article 37 of Memorandum of Association and Rules and Regulations of Bihar cricket Association, the Electoral Officer was appointed to oversee, supervise and conduct election to the committee of management of Bihar Cricket Association. The process of election had commenced with the issue of election schedule on 28-08-2022. With the calling of nominations from DCA/full members to nominate their representatives, the process, being time bound in nature, began as per the notified schedule in order to maintain the sanctity of the process.
A reference of directions made by Hon. Ombudsman of Bihar Cricket Association, dated 12 -09-2022 was placed before me regarding Madhubani DCA which mentions to accept the authorisation of an individual “PROVISIONALLY” till further orders to be passed on 17-09-2022. Though I beg to disagree with the orders of Hon Ombudsman, as the election process has already commenced way back on 28-08-2022, but keeping the sanctity of the office of Ombudsman, decided to wait for the orders till 23.50 hrs on 18-09-2022. ( around 32 hrs. after the date given by Hon.Ombudsman)
Respecting the said directions, though not mandatory and maintainable, the publication of Final Electoral Roll of Bihar Cricket Association which was ready by 16.00 hrs was kept on hold till 23.50 hrs on 18-09-2022, however there was no directions received from Hon.Ombudsman in this connection till 23.50 hrs in the mid night. Finally at 23.55 the Final Electoral Roll was caused to be published. To our utter embarrassment, directions dated 17-09-2022 was received by the electoral officer on19-09-2022 at 13.50 hrs but dated 17-09-2022 and which was placed before this authority.
The process of election has to strictly follow the time lines to maintain its sanctity, devoid of undue influence or interference of any recommendatory authority or person. For this reason, an impartial and experienced person is appointed to conduct the process of election. The directions of Hon. Ombudsman are not acceptable by this authority to change the time lines at this stage for any minor reasons. Since the prescribed time lines have already crossed, any recommendations of similar nature are not tenable,hence, these recommendations of Hon. Ombudsman are not being considered. Accordingly directions are given to CEO BCA, keeping in view that the time lines prescribed for the election are sacrosanct, the entries in the final electoral Roll 2022 of the BCA at serial No.33 and 34 shall be disregarded and final electoral Rollis deemed to be considered only of 32 DCAs which shall not include Arwal and Madhubani DCAs.
The above needs to be followed by the chief Executive Officer BCA. This may be notified immediately on the official website for the information of all the concerned.
