Sub: Regarding “Cease To Work”...
Sir,
I, the undersigned, have been directed to inform you the following:
By an unanimous decision taken in the meeting of the General Body of Bihar Cricket Association held on 31st Of January, 2020 at Hotel Aditya Inn, Ara, You have been declared “CEASE TO WORK” and all the duties, powers and jurisdiction empowered to you as Honorary Secretary is being allowed/ handed over to the Honorary Joint Secretary (Sri Kumar Arvind) with immediate effect.
IT WAS ALLEGED THAT SRI SANJAY KUMAR, HONORARY SECRETARY LEFT THE PLACE OF MEETING TAKING AWAY THE RECORDS, REPORTS, AUDITED STATEMENT OF ACCOUNTS AND OTHER IMPORTANT DOCUMENTS WHICH WERE SUPPOSED TO BE TABLED TODAY IN THE MEETING.
ALLEGATIONS OF ‘CONFLICTOF INTEREST’, YOU WERE ACCUSED OF USING YOUR POSITION AND POWER TO INFLUENCE THE SELECTION OF YOUR OWN SON IN THE SENIOR TEAM. THE NAME OF YOUR SON (SHIVAM S. KUMAR) WAS NOT AMONG EVEN THE STAND BYE PLAYERS SELECTED BY THE NATIONAL SELECTORS. IT WAS ALSO ALLEGED THAT BY THIS ACT OF YOURS, YOU HAVE PROVIDED UNDUE ADVANTAGE TO YOUR SON AND EVEN FAVOURED HIM MONETARY BENEFITS, WHICH IS A CRIMINAL OFFENCE ALSO AND LIABLE TO INSTITUTION OF F.I.R.
IT WAS ALLEGED THAT WITHOUT ANY PRIOR APPROVAL OR CONSENT OF ANY OTHER OFFICE-BEARER OR COMMITTEE OF MANAGEMENT OF Bihar Cricket Association, YOU HAVE FLOATED TENDERS, ALLOTTED WORK ORDERS ON YOUR OWN.
IT WAS ALLEGED THAT YOU HAVE MADE HUGE PAYMENTS TO PARTIES/VENDORS/AGENCIES WITHOUT APPROVAL FROM Committee Of Management. THIS IS AGAIN A CRIMINAL ACT AND IN DIRECT VIOLATION OF THE RULES.
IT WAS ALLEGED THAT THERE WAS NO TRANSPARENCY IN TENDER PROCESS, SELECTION/NOMINATION OF AGENCIES AND ISSUING WORK ORDER BY GIVING UNDUE ADVANTAGE TO YOUR KITH & KINS.
IT WAS ALSO ALLEGED THAT NOMINATIONS/APPOINTMENTS HAVE BEEN MADE BY YOU AND PAYMENTS ARE BEING MADE FROM Bihar Cricket Association Account TO SUCH PERSONS WITHOUT ANY APPROVAL OR CONSENT. THIS IS ALSO AN UNETHICAL ACT WHICH IS AGAIN MISUSE OF POWER.
I have been further directed to contact you personally and ask you to kindly hand over the Bihar Cricket Association’s Cheque book, password of website as well as email id for making it available to the new functionary. I met you yesterday i.e. on 1st of February, 2020 and intimated it orally.
I have not received any inputs from your side, therefore, it is requested to you to please handover the same within 24 hours of receipt of this mail so that i can be able to make compliance to the instruction/direction, otherwise, I shall be left with no option but to take appropriate legal action and instituting F.I.R. against you as directed to me earlier.
This is for your information as directed to me and for necessary action. However, formal show cause Notice shall be issued to you by the appropriate authority.
